Mulah Adventures

Terms & Conditions

The booking, payment, service, responsibility and legal terms that apply to travel arrangements made through Mulah Adventures.

Introduction

These terms apply to enquiries, quotations and travel arrangements made with Mulah Adventures. By accepting a quotation, paying a deposit or asking us to confirm services, the client confirms that they have had an opportunity to read these terms and agree to them. The client includes the person making the booking and any traveller represented by that person. Specific terms in a written quotation, itinerary or supplier confirmation may supplement these terms.

Bookings and payment

Bookings should be confirmed in writing or by email. Unless a quotation states otherwise, a deposit of 50% of the confirmed tour cost is required to secure arrangements. Bookings made within 45 days of commencement may require full payment immediately. Final payment is due no later than 40 days before travel unless agreed in writing. We may release or cancel unconfirmed services where payment is not received by the stated deadline. Supplier availability, taxes, fuel costs, exchange rates, park charges and government fees may change before confirmation; any material adjustment will be explained before affected services are confirmed.

Quotations and inclusions

A quotation and final itinerary will state the services included, such as accommodation, ground transport, guide services, meals, activities, park or conservancy fees and domestic flights where applicable. International flights, visas, passports, vaccinations, travel insurance, personal spending, optional activities, hotel extras, tips and services not expressly listed are excluded. The client should check the final itinerary carefully and raise any uncertainty before payment.

Changes and substitutions

We will try to provide the confirmed accommodation, vehicles, routes and activities. Travel conditions, supplier availability, weather, road access, safety requirements, government decisions or other events may require a comparable substitution or itinerary adjustment. We will communicate material changes as soon as reasonably possible and work toward an alternative of similar value. Costs caused by a client-requested change, missed connection, late arrival, voluntary deviation or failure to follow the itinerary may be charged to the client.

Travel documents and responsibilities

The client is responsible for valid passports, visas or electronic travel authorisations, transit permissions, health certificates, accurate traveller information and timely arrival for flights, trains and transfers. Travellers must follow the reasonable instructions of guides, drivers, accommodation staff, park authorities and local laws. Special dietary, medical, mobility or other requirements must be disclosed before confirmation so that reasonable arrangements can be assessed. Clients should obtain comprehensive travel insurance covering medical treatment, evacuation, cancellation, curtailment, baggage and personal liability.

Transport and activities

Vehicles may include safari Land Cruisers, vans, coaches, aircraft or other appropriate transport. Seat belts must be worn where provided. Wildlife viewing, walking safaris, balloon flights, boating, mountain activities, remote-road travel and other outdoor experiences carry inherent risks. Clients must follow safety instructions and understand that conditions in wilderness and remote areas may affect timing and access.

Suppliers and responsibility

Mulah Adventures coordinates services provided by independent airlines, hotels, lodges, camps, vehicle operators, guides and other suppliers. We select partners with reasonable care and will assist with problems, but supplier services are also subject to their own terms and operational limitations. Nothing in these terms excludes liability that cannot lawfully be excluded or limits a client's rights under applicable law.

Conduct and refusal of service

We may decline or end arrangements where a traveller's conduct creates a serious safety risk, damages property, breaks local law or materially affects other guests. Any refund in such a case will be assessed against unused recoverable services and costs already incurred. Clients remain responsible for damage, fines or losses caused by their actions.

Force majeure

We are not responsible for delay, loss, extra expense or failure caused by events outside reasonable control, including severe weather, floods, fire, disease outbreaks, strikes, civil unrest, terrorism, war, border restrictions, government action, road closures, supplier failure or changes to park, immigration or aviation rules. We will make reasonable efforts to help revise arrangements, but non-recoverable costs may remain payable by the client or their insurer.

Complaints

If a problem occurs during travel, notify the guide, property, driver or Mulah Adventures contact promptly so that a practical remedy can be attempted. Written complaints should be sent as soon as possible after travel with relevant details and supporting documents.

Governing law

These terms and disputes arising from arrangements made with Mulah Adventures are governed by the laws of the Republic of Kenya, subject to any mandatory consumer protections that apply. The parties will first try to resolve concerns in good faith before pursuing formal proceedings in the competent courts of Kenya.

Please review the applicable quotation and supplier terms before paying a deposit. Mulah Adventures may update these pages when services or legal requirements change.
